The user : any person using the site as result of just browsing or placing an order or completing a purchase. Thus, the "use" of the site is referred to as browsing or placing an order.
TCs : Conditions générales de vente
Art. 1 : Purpose
a. Scope
These terms and conditions shall be regarded as being implicitly accepted by the site user.
b. The user
The user placing an order or completing a purchase on the site is deemed to be of full age and responsible for his/her buying act.
c. Updating the TCs
The TCs may be updated, hence the applicable TCs shall be those published on the site when it is visited by the user.
Art. 2 : Order
The user shall agree that placing an order on the site shall be equal to signing an order form with all that implies in terms of validity.
At each stage of the order, Ludiloo shall communicate with the user by e-mail to confirm the order and report on the follow-up process. The messages shall be sent to the e-mail address the user supplies when making the order. The user is responsible for the e-mail address supplied to Ludiloo.
Ludiloo shall reserve the right to refuse an order or apply further conditions, which shall then be notified to the user.
Art. 3 : Merchandise
All the items featured on the site are carefully described by Ludiloo in the light of information it has available. Ludiloo may not be held liable if, in spite off all the precautions taken, a description unfortunately contains an error or some information is missing.
Each merchandise description file features the stock status. Ludiloo keeps careful track of the stock in real time but if an item is listed as available in stock and this is unfortunately not the case, Ludiloo shall offer the user the option of cancelling the order or purchasing another item, on the understanding the user shall not be entitled to compensation because of this.
The items on offer are consistent with current Belgian legislation. A foreign user buying an item shall be deemed to be aware of whether or not the item is consistent with the legislation applied in the person's own country.
Ludiloo may not be held liable for any misuse of items acquired via the site. Similarly, the user shall be liable for any property damage and/or physical injury as a result of an item being misused.
Art. 4 : Price
The price of the items shall be understood to mean including VAT (for European Union countries) and not including freight charges. The prices referred to may be changed at any time in line with market trends. These prices shall be notified provided there is no encoding error. Orders placed in these circumstances shall therefore be automatically cancelled.
Institutions and professional users are requested to get in touch with Ludiloo to discuss the opportunity for enjoying special rates.
Art. 5 : Payment
a. Ogone
Orders placed on the site are paid for via the Ogone secure payment platform. You have a choice of electronic payment systems:
- Credit card: Visa/Mastercard
- Bancontact/Mistercash
- Dexia netbanking
Transactions undertaken via the site are covered by the Ogone secure payment system. The SLL protocol is used to encrypt any information exchanged in order to process the payment. The information cannot be detected, intercepted or used by third parties. Nor is it kept in our computer systems. This means Ludiloo shall not be privy to the user's banking information during any stage of the purchasing procedure. Ludiloo is committed to guaranteeing the security of purchases from the site.

b. Failure to pay
Ludiloo shall reserve the right to refuse to meet an order from a user who has not fully paid or partly a previous order or with whom a payment dispute is under administration.
Art. 6 : Transport and delivery
a. Transport operator
Ludiloo shall make its deliveries via DPD according to the rates referred to in article 6.c. below.
b. Delivery procedures in Belgium
The delivery agent shall report during the day to the delivery address featured on the order (the address may not be the same as the invoicing address), where the package shall be handed over to the person present and signed for. Should the person be absent, the delivery agent shall leave a notification card and report to the address a second time, generally 24 hours later. Should the addressee be absent during the second visit, the delivery agent shall leave another notification card and get in touch with the user to arrange an appointment for a third and final attempt to deliver the item. Should this attempt be unsuccessful, the package shall be kept for a few days for the user at the nearestDPD depot then returned to Ludiloo.
If the package is returned to Ludiloo, the user may decide to retain the order or otherwise. Should the package need to be sent once more, the new delivery costs shall be chargeable to the user on the understanding that the delivery costs already incurred may not be refunded.
Ludiloo may not be held liable for an error or being unable to make a delivery owing to the user failing to ensure the delivery address or telephone number is properly encoded on the order.
c. Delivery costs
- The flat-rate delivery costs for Belgium amount to €3,99. Purchases worth €50 or more shall be delivered free of charge.

d. Delivery time
The average delivery time in Belgium is 2 to 3 working days.
e. Late deliveries
Ludiloo does its utmost to ensure packages reach the user at the earliest opportunity but a delivery may exceptionally be later than what was agreed upon. The package may be tracked to find out its location and how the delivery is progressing. The user is required to notify Ludiloo when actual time exceeds allocated time so that Ludiloo can act swiftly to ensure the package is not lost (see Article 6.f. of these TCs ).
If the delivery time should nonetheless be too long for the user, the latter shall be entitled to return the package to Ludiloo pursuant to the conditions featured in article 7 of these TCs in reference to returned items.
f. Damage to and loss of the package
Ludiloo does its utmost to ensure goods are firmly packed and cannot move in their packaging. Should an item nonetheless arrive in a poor condition, the user is required to notify Ludiloo within 48 hours after which time no complaint may be dealt with. As each package is insured, Ludiloo shall be responsible for compiling the documentation for lodging a complaint against the transport operator and compensating the user.
Should the package be lost, the user is required to notify Ludiloo within 7 days after receiving an e-mail to confirm the package has been sent. No complaint may be accepted after this deadline. Ludiloo shall be responsible for lodging complaints against the transport operator.
When the package is damaged or lost, Ludiloo may need information available to the user. The user shall therefore undertake to provide the information to Ludiloo at the earliest opportunity.
The reimbursement and compensation procedures and times, if there are any, shall be those defined by the transport operator. The user shall implicitly agree to these conditions by placing an order via the site.
g. Merchandise reference errors
The user is required to check what the package contains as soon as it arrives. In the event of any unfortunate merchandise or quantity errors, the user is required to notify Ludiloo within 48 hours after receiving the package.
Ludiloo shall then consider whether the complaint is justified and shall then offer the user compensation, as described below. In the event of a missing item, the user may choose between being reimbursed the cost of the relevant item or having it delivered free of charge. In the event of a reference error, Ludiloo shall exchange the item, with the costs of this procedure being chargeable to Ludiloo. No other compensation has to be taken into consideration.
Art. 7 : Cancellation of an order and returned items
The user has 14 days after receiving the package to waive the purchase. In this case, the user has to notify Ludiloo by e-mail (info@ludiloo.be). The merchandise in question shall then be returned to Ludiloo within 5 days after the decision to cancel the order is notified. These items have to be in a perfect condition and in their original intact packaging. They have to be carefully wrapped to avoid the items being damaged during the return journey. The costs of returning the items shall be chargeable in full to the user. The user shall be responsible for ensuring the return operation is of an acceptable standard and the process is suitably tracked.
Ludiloo shall reserve the right to refuse a returned item if it fails to meet the aforementioned conditions, particularly if it is discovered that the packaging has clearly been opened or damaged by the user.
After accepting the returned item, as notified to the user by e-mail, Ludiloo has 15 days within which to reimburse the costs of the returned items, pursuant to the conditions governing returned items.
Art. 8 : Liability
Ludiloo shall not accept any liability for the content of sites to which is it directly or indirectly linked, via hyperlinks or any other system.
Ludiloo does its utmost to ensure the site operates as effectively as possible but it cannot provide any guarantee about this, hence it cannot be held liable for any damage as a result of the site being unavailable.
